TheYardMap Terms of Service

TheYardMap is an online platform that allows users to discover, create, and promote garage sales, yard sales, estate sales, moving sales, and similar community events based on location.

TheYardMap does not sell products listed by users. Transactions occur solely between buyers and sellers.

TheYardMap offers optional Premium Membership subscriptions that provide enhanced features.

You must be at least 21 years old, or the legal age in your jurisdiction, to create an account or publish listings.

By using TheYardMap, you represent that:

• the information you provide is accurate;
• you have the legal right to organize the advertised sale;
• you will comply with all applicable laws.

Users are responsible for:

• maintaining the confidentiality of login credentials;
• all activity occurring under their account;
• providing accurate account information;
• promptly updating any changes.

TheYardMap reserves the right to suspend or terminate accounts that violate these Terms.

TheYardMap offers optional monthly Premium subscriptions.

Premium features may include:

• enhanced listing visibility;
• featured listings;
• advanced search features;
• additional promotional tools.

Subscription fees are charged automatically until cancelled.

Unless required by law, subscription payments are non-refundable.

Users are solely responsible for all content they publish.

Listings must be truthful and include accurate information regarding:

• location;
• date;
• time;
• description;
• items offered.

Users may only advertise events they are authorized to host.

Misleading or fraudulent listings are prohibited.

The following items may NOT be listed, promoted, sold, exchanged, or offered through TheYardMap:

• illegal drugs
• controlled substances
• narcotics
• firearms
• ammunition
• weapons
• explosives
• hazardous chemicals
• toxic substances
• counterfeit goods
• stolen property
• recalled products
• prescription medications
• tobacco products where prohibited
• alcohol where prohibited
• human organs or biological materials
• endangered wildlife products
• illegal digital goods
• any item prohibited under applicable law.

TheYardMap reserves the right to immediately remove any listing violating this policy without notice.

Repeated violations may permanently terminate the user's account.

Users agree to behave respectfully.

Users may not:

• harass others;
• threaten anyone;
• discriminate;
• post offensive content;
• impersonate another person;
• submit false reports;
• manipulate ratings or listings;
• interfere with the operation of the platform.

By publishing a sale location, the seller understands and agrees that:

• members of the public may visit the advertised address;
• visitors may arrive during the advertised sale hours;
• TheYardMap cannot control visitor behavior;
• the seller voluntarily chooses to publish the location.

Users should only publish locations they are legally authorized to use.

All transactions occur directly between buyers and sellers.

TheYardMap:

• is not a party to any transaction;
• does not inspect items;
• does not guarantee item quality;
• does not guarantee availability;
• does not verify ownership;
• does not guarantee payment.

Users assume all risks associated with purchases and sales.

TheYardMap is solely an advertising and discovery platform.

To the fullest extent permitted by law, TheYardMap shall not be liable for:

• theft;
• burglary;
• vandalism;
• personal injury;
• property damage;
• lost profits;
• financial loss;
• disputes between users;
• fraud;
• scams;
• inaccurate listings;
• cancelled sales;
• visitor conduct.

Users participate entirely at their own risk.

Users are encouraged to:

• meet only during daylight hours;
• keep valuables secured;
• supervise children;
• avoid unsafe situations;
• contact local authorities if necessary.

TheYardMap does not provide security services.

All TheYardMap logos, trademarks, graphics, software, designs, and content remain the exclusive property of TheYardMap.

Users may not copy, reproduce, modify, or redistribute TheYardMap materials without written permission.

Your use of TheYardMap is also governed by our Privacy Policy.

By using the platform, you consent to the collection and processing of information as described therein.

TheYardMap may suspend or terminate accounts for:

• fraud;
• abusive behavior;
• prohibited listings;
• repeated policy violations;
• illegal activity;
• attempts to harm the platform.

Termination may occur without prior notice.

TheYardMap is provided "AS IS" and "AS AVAILABLE."

We make no warranties regarding:

• uninterrupted availability;
• accuracy;
• reliability;
• security;
• fitness for a particular purpose.

Use of the platform is entirely at your own risk.

To the maximum extent permitted by law, TheYardMap, its owners, employees, affiliates, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to the use of the platform, including but not limited to loss of data, loss of profits, property damage, personal injury, or business interruption.

Where liability cannot be excluded by applicable law, TheYardMap's total aggregate liability shall not exceed the amount paid by the user for Premium Membership during the preceding twelve (12) months.

You agree to defend, indemnify, and hold harmless TheYardMap and its owners, employees, affiliates, licensors, and partners from any claims, liabilities, damages, judgments, losses, costs, or legal fees arising from:

• your listings;
• your sales;
• your conduct;
• violation of these Terms;
• infringement of third-party rights.

We reserve the right to modify, suspend, discontinue, or update any part of the platform at any time without prior notice.

TheYardMap may update these Terms periodically.

Continued use of the platform after changes become effective constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TheYardMap operates, without regard to conflict of law principles, unless otherwise required by applicable consumer protection laws.
